Music Clearance refers to the process of obtaining the licenses that allow you to use pieces of music in your audio/visual projects. For large companies that need to use lots of music, it can be a large and intricate operation. Sometimes there are even hundreds of tracks that require tons of work to acquire rights to. That’s where Audiosocket comes in!
Clearing a piece of music normally requires two types of licence: a "Master Licence" to use the recording (usually controlled by the label or person that financed the recording), and a "Synchronization Licence" to cover the actual composition itself (controlled by the songwriter, composer or publisher). You must obtain both licences to use music with any visual project.
We refer to the "Master Side" or "Sync/Publishing Side" when referring to the controller(s) of either licence. Quotes from rightsholders are often given as a rate "per side". For example, "$1,000 per side" would mean $1K for the sync licence + $1K for the master licence = $2,000 total for both licences.
No two clearances are the same, and as such timescales can differ vastly. Tracks controlled by independent labels and publishers can normally be cleared in 2-6 weeks, whereas the majors can take up to 12+ weeks - especially when several writers/rightsholders are involved.
That's why it's important to start the process as soon as possible, to ensure there is plenty time to get all licences in place prior to your publish/release date. Talk to us about your needs and we do our best to provide an approximate timescale.
Many labels and publishers will reject requests to use a song in perpetuity, so you may need to consider licensing for a fixed term instead (which could be 1 week or 10 years, depending on your budget). At the end of the licence period, you may then be able to re-licence for an additional term.
Many labels and publishers quote their fees on a MFN basis, which means all parties receive the same fee relative to their ownership % share. So, if the song's label quotes $1,000 for the Master License but the publisher receives $1,200 for the Sync License, the label would then also require the same fee (i.e. $1,200) for the master license.
It may be that rightsholders do not agree to the terms or budget requested, and sometimes rightholders simply do not approve of the use.
